La Savonnerie de l’Alchimiste Ltd. – General Terms and Conditions

In these General Terms and Conditions “La Savonnerie de l’Alchimiste “ shall mean the company La Savonnerie de l’Alchimiste Ltd., a company registered in the United Kingdom, company number 07524888, having its registered address at Sutherland House, 1759 London Road, Leigh-on-Sea, Essex, SS9 2RZ, United Kingdom.

These General Terms and Conditions and the Privacy Policy govern the sale of goods by La Savonnerie de l’Alchimiste, to you, the customer, and your use of our website, www.savonnerie-alchimiste.com, and will form the basis of the contract between us.

By placing an order with us , you accept and agree to be bound by these General Terms and Conditions which constitutes the entire agreement between us.

The Contract Between Us

For orders by letter, Email or phone:

Upon receiving your order and subject to availability of the products ordered, we will send you an electronic invoice summarising the details of your order and the amount due. By paying the invoice, you confirm your order and agree to these General Terms and Conditions. The contract is formed (subject to these General Terms & Conditions) when La Savonnerie de l’Alchimiste has issued the invoice and you have paid it. The contract is completed when the goods are delivered (also subject to these General Terms & Conditions).

For orders via our website:

When terminating your online purchase and paying the amount due,  you confirm your order and agree to these General Terms and Conditions. The contract is formed (subject to these General Terms & Conditions) when you terminate your online purchase and pay the amount due. The contract is completed when the goods are delivered (also subject to these General Terms & Conditions).

Orders

All orders for goods made by you , by letter, telephone, email, and via our website are subject to these Terms and Conditions.

Orders may only be made by persons who are acquiring goods or services for their own use or consumption, and you must not acquire goods from us via the website for resupply (whether in trade or otherwise).

If you are purchasing on behalf of another entity such as a company you warrant you have the authorisation to agree to these terms and conditions on behalf of the entity.

We only sell items to adults (i.e. those aged 18 or over). By placing an order with us you confirm that you are of legal age.

You agree that we may deliver the goods in instalments if we suffer a shortage of stock or other genuine and fair reason provided you are not liable for any extra charges.

Cancellations or changes before despatch

It may not be possible to prevent an order from despatch, once it has been placed and paid. However, if you inform us that you wish to change or cancel an order which hasn’t been shipped, we will try to amend or cancel it, issue a corrected invoice if your original order has already been invoiced and refund you any amount due if applicable.

Cancellations or changes after despatch

Once despatched we are unable to stop delivery or cancel the order.

However, If you wish to cancel or change your order after despatch you may return the goods, in whole or in part, to us as per our ‘Cancel and Return Policy’ below.

Payment

We will not ship goods before payment has been received in full. We use Stripe and PayPal to process on-line payments. Via Stripe, you can pay the invoice by credit or debit card. Via PayPal, you can pay the invoice from a PayPal account. You can also pay by wire transfer, quoting the invoice number. We cannot process credit or debit card payments other than through the Stripe or PayPal interface. Please do not send us any payment information such a credit- or debit card numbers.

All payments processed via Stripe’s payments system are subject to Stripe’s terms and conditions.

All payments processed via PayPal’s payments system are subject to PayPal’s terms and conditions.

Prices

Prices are displayed on our website in € or £ according to your selected preference and online purchases are settled in the currency selected.

For orders by letter, Email or phone, the price in € on the website will be determining, but we can invoice you in £ at your discretion. In that case, the price in £ may differ from the price in £ displayed on our website due to currency fluctuations.

Prices displayed on the website include Value Added Tax, if applicable.

If we have inadvertently displayed an incorrect price and an invoice has not yet been issued, we reserve the right to contact you as soon as possible to give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to reach you, your order for the incorrectly priced item may be cancelled, and we are not obliged to honour such orders.

If the invoice has been paid, we will honour the price posted at the time you placed the order.

Product Description and Specifications

We have made every effort to ensure that the descriptions and photographs of goods displayed on our website give a correct impression of the item. However the information is not contractually binding. We reserve the right from time to time to vary the prices, quantities, dimensions and specifications of the goods displayed on our website without prior notice.

Privacy Policy

By placing an order, you will send us certain personal information (e.g. name, address, email address, telephone number). We will use this information to process your transaction. We may also transfer your data to third parties for the purposes of payment, delivering any goods you have ordered to you and fulfilling your order.

Please note that during the order fulfillment process, your personal information may be shared with entities outside the European Union.

With your explicit and prior permission, we may also use the information to send you newsletters and marketing material about similar goods from our company by electronic communication. You will be given the possibility to opt-out of future communications in each electronic communication.

We will not share your personal data with any third parties, other than as necessary for the purposes of processing your order, delivering any goods you have ordered to you and fulfilling your order.

Content & Intellectual Property Rights

Our website, its products and content is protected intellectual property. You are only allowed to use content found on this website if expressly agreed by La Savonnerie de l’Alchimiste in writing. Any reproduction or redistribution of our intellectual property may result in civil and criminal penalties.

The content, defined as: graphics, photographs, images, sounds, music, audio or text are to the best of our knowledge accurate and complete. However, we do not warrant that it is error-free. Nor do we warrant that the functions within the site i.e. html, content and functional aspects are error-free. Equally, we cannot promise that our website is available at all times and we do not accept any liabilities as a consequence of errors in the content or our website being unavailable.

General Cancel and Return Policy

You have the right to cancel your order without cause within a period of 14 days from the day after you receive the goods. This right applies provided that any seals and the original packaging are intact and you have not started using the product. This right does not apply to bespoke products.

If you wish to cancel and return your purchase, please contact us by Email at info@savonnerie-alchimiste.com with the order number quoted on the invoice. We will then give you instructions about where to return the goods which must be done within 14 days of your receiving our instructions. When the goods have been received and checked, a refund for the goods and delivery costs will be issued as soon as possible. We will contact you for repayment details. Please note that the cost of returning the goods is your responsibility.

Your statutory rights regarding damaged, defective or incorrect goods are not affected by this.

Damaged, Defective or Incorrect Goods

Upon delivery, we warrant that the goods will:

  1. be of a satisfactory quality;
  2. be fit for any purpose held out by us and
  3. conform to their description.

If you take delivery of a shipment from us and the goods being delivered to you have been damaged in transit, or are not the product(s) that you ordered or are defective, you must inform of us of this within 30 days of receiving the goods. You will have the option to either exchange these items without charge to you, or receive a full refund. We reserve the right to request you to return the goods to us and/or request photos of the damage and packaging in order to enable us to investigate the matter.

Deliveries Outside the European Union

The products presented on our website are suitable and approved for use for customers within the European Union. Customers who choose to purchase items for usage and distribution to locations outside European Union do so at their own risk and have a personal responsibility regarding compliance with local laws. Please note that for items you order for delivery outside the European Union, you are considered the importer and must comply with all laws and regulations of the country in which the items are to be delivered.

Customs Duties

Items for delivery outside the European Union may be subject to import duties, taxes and fees. For customs purposes, shipments for delivery outside the European Union will be accompanied by an invoice in the English language. You, the buyer, is responsible for paying any such import duties, taxes and fees including any costs associated with the customs handling. Failure to do so will result in the parcel being returned. In that case, we will not refund the cost of postage and packaging. Please note customs handling may be subject to opening and inspection by customs authorities. In that case, we cannot guarantee that your goods will arrive in the same condition that they were dispatched.

Limitation of Liability

We do not exclude liability for: 1) any fraudulent act or omission; or 2) for death or personal injury caused by negligence or breach of our other legal obligations and nothing in the General Terms and Conditions shall limit your statutory rights under the laws of England and Wales.

Subject to this, to the maximum extent permitted by law, we accept no liability and shall not be responsible for any loss or damage, whether foreseeable or otherwise, including direct, indirect, consequential, special or exemplary damages however they may arise.

Force majeure

We will not be responsible to you for any delay or failure to comply with our obligations under these General Terms & Conditions if the delay or failure arises from any cause beyond our reasonable control.

However, if as a result, we cannot deliver the goods to you, you are entitled to a full refund.

Changes to these General Terms and Conditions

We reserve the right at any time to make changes to these General Terms & Conditions. You will be subject to the policies and terms and conditions in force at the time you place an order.

We reserve our right to transfer our rights and obligations under these General Terms and Conditions to another organisation. However you may only transfer your rights or your obligations under these General Terms and Conditions to another person or organisation if we agree to this in writing.

Entire Agreement

These General Terms and conditions and the resulting contract between us constitutes the entire agreement between the parties with respect to the matters set out herein.

No promise, agreement, representation or modification to these General Terms and conditions and the resulting contract between us shall be of any force or effect between the parties, unless confirmed and signed by both parties.

Severability

If any of the General Terms and Conditions and the resulting contract between us are deemed invalid, void or unenforceable for any reason, it will be deemed severable and not affect the validity and enforceability of the remaining General Terms and Conditions.

Governing Law and Jurisdiction

Unless we agree otherwise in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.

These General Terms and Conditions and the resulting contract between us are governed by the laws of England and Wales and are under the exclusive jurisdiction of the English courts.

For versions of these Terms and Conditions in other languages than English, this version in English will be determining.
